On October 13, 2022, the Department of Labor (DOL) published a Proposed Rule revising the guidance under the Fair Labor Standards Act regarding the distinction between employees and independent contractors. NPGA Regulatory staff engaged with other trade associations, government engagement sessions, and other stakeholders to discuss the Proposed Rule’s impact on our membership. The comment period on the Proposed Rule closed on December 13, 2022, and NPGA submitted a comment focused on employer liability, contractor economic opportunities, and how the current distinctions work properly in the propane industry.
