The Occupational Health and Safety Administration (OSHA), and its state-delegated enforcement authorities, have sought to apply process safety management provisions to certain propane facilities which should be exempted by the retail facility exemption. OSHA has taken action against a number of different propane companies in a variety of states. While NPGA continues to pursue advocacy to stop OSHA from its illegal enforcement actions taken without proper authority, NPGA may be forced to seek judicial remedies. If you are being investigated by OSHA for issues of process safety management, please inform NPGA General Counsel Benjamin Nussdorf immediately so the NPGA legal team can investigate potential legal actions on behalf of the association and the industry as a whole. If NPGA is not aware of the action within 60 days of your receiving notice, it may not be able to help you. For questions or concerns, please reach out to Mr. Nussdorf.
