On April 8, 2025, the White House issued a new Executive Order, “Protecting American Energy from State Overreach.” It directs the U.S. Attorney General to “identify all State and local laws, regulations, causes of action, policies, and practices…burdening the identification, development, siting, production, or use of domestic energy resources that are or may be unconstitutional, preempted by Federal law, or otherwise unenforceable.” This process will prioritize state and local laws, policies, and practices “purporting to address ‘climate change’ or involving ‘environmental, social, and governance’ initiatives, ‘environmental justice,’ carbon or ‘greenhouse gas’ emissions, and funds to collect carbon penalties or carbon taxes.”
The National Propane Gas Association (NPGA) is in direct communications with the White House related to this critical order. NPGA is crafting a state-by-state list of laws and regulations it feels the U.S. Attorney General’s office should review and seek to revoke. NPGA will then, to the extent permitted, work with the Attorney General’s office as it seeks to roll back, via litigation or otherwise, any such burdensome and unconstitutional laws.
