Last week, Arizona Governor Katie Hobbs signed Senate Bill (SB) 1056 into law. This bill makes it a Class 2 misdemeanor for an unauthorized individual to fill, evacuate, or deface a propane container. Since the unauthorized use and defacement of propane tanks is currently only considered a Class 3 misdemeanor, propane marketers in the Grand Canyon State have found it difficult to get law enforcement officials to properly enforce this law and deter illicit and potentially unsafe behavior.
Arizona Propane Gas Association (AZPGA) Executive Director Barry Aarons has been championing this legislation since it was introduced. “We are very happy that with the passage and Governor’s signature of SB 1056 local law enforcement will have the tools necessary to pursue violators of Arizona’s container law,” said Aarons. “We are greatly appreciative of the bill’s sponsor, Senator David Gowan, for his continued support of our industry and specifically for the work that he did to get this bill enacted.”
NPGA has a detailed list of state propane container laws available on the My State section of the NPGA website. As of the 2023 sales report, Arizona was the 29th largest state market in the country, with 112 million gallons sold.
